These Terms govern your use of FamilyArk.app. By using this site or purchasing Family Ark, you agree to these Terms.
Purchases
Family Ark is sold as a one-time purchase per platform, or as a bundle covering both Windows and Android. Pricing and available options are shown on the Pricing & Download page at the time of purchase. If you are not satisfied with Family Ark, for up to 14 days you can contact us for a full refund. You need to use the contact form and explain why you would like a refund.
Free-download codes
Codes that unlock a free download are issued at our discretion, may be limited in number of uses, restricted to a specific platform, and may expire. Misuse or redistribution of a code beyond its intended recipient may result in it being disabled.
NO WARRANTY / “AS‑IS” DISCLAIMER This software is provided on an “as‑is” and “as‑available” basis, without any warranties of any kind, whether express, implied, or statutory. The developer expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement.
The developer does not warrant that the software will be error‑free, uninterrupted, secure, or free of defects, nor does it guarantee that any issues can or will be corrected.
Limitation of liability
To the maximum extent permitted by law, the developer and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, loss of profits, business interruption, or any other damages arising out of or related to the use of this software.
In all cases, the total liability of the developer for any claim arising from or relating to this software shall not exceed the original purchase price paid by the user for the software.
Not legal or medical advice
Family Ark is a tool for organizing information and wishes. It does not provide legal, medical, financial, or tax advice, and using it does not replace a will, trust, power of attorney, or other legal document. Consult a qualified professional for advice specific to your situation.
Changes to these Terms
We may update these Terms from time to time. Continued use of the site after a change constitutes acceptance of the updated Terms.
Governing law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Pennsylvania, without regard to its conflict‑of‑law principles. Any disputes arising from or relating to this software shall be resolved exclusively in the state or federal courts located in Pennsylvania, and the user consents to the jurisdiction of those courts.

End-User License Agreement (EULA)
License grant
Subject to payment, you are granted a personal, non-transferable license to install and use Family Ark on the platform(s) you purchased (Windows, Android, or both under the bundle license).
Updates and upgrades
Bug fixes and minor feature additions are provided free of charge for the life of the product. A major upgrade — defined as a complete redesign of the program with updated functionality — is a separate, optional paid purchase and is never required to continue using your existing version.
Ownership
Family Ark and all associated intellectual property remain the property of Ark Software LLC. This license grants the right to use the software; it does not transfer ownership of it.
Data
All data you enter into Family Ark is stored locally on your device and encrypted under your control. Ark Software LLC has no access to, and no ability to recover, this data.
Termination
This License shall remain in effect until terminated by either the user or the developer. The user may terminate this License at any time by discontinuing use of the software and deleting all copies in their possession.
The developer may terminate this License immediately and without prior notice if the user fails to comply with any term of this Agreement, including unauthorized copying, distribution, modification, or misuse of the software.
Upon termination, the user must cease all use of the software and delete or destroy all copies. Termination does not limit the developer’s rights to seek remedies for violations of this Agreement.
All provisions that by their nature should survive termination (including limitations of liability, disclaimers, and governing law) shall continue to apply.
